Ministry of Transport proposes to amend regulation on licensing works with dangerous goods on railway transport

Ministry of Transport of the Russian Federation elaborated draft of the resolution of the Government of the Russian Federation which defines more clearly the manner of licensing works on loading and unloading of dangerous goods on railway transport, reported Zalina Katasonova, consultant of the Legal regulations, operational safety and technical policy division of the Department of State Policy in the field of railway transport of the Ministry of Transport of the Russian Federation.

“Approximately 99% of all dangerous goods are unloaded on railways and in places of non-public use”, clarified Zalina Katasonova. – “This is stipulated by Regulations on transportation of dangerous goods by rail.” But current Regulations require licensing operations with dangerous goods that are done within railway infrastructure, while Article 2 of the Federal Law “On railway transport of the Russian Federation” relates the term “infrastructure” only to public railways. Therefore, rules of licensing apply only to operations performed on public railways, while as per rules of transportation of dangerous goods the latter are handled only on non-public railways.

Ministry of Transport proposes to amend Regulations on licensing activities connected with dangerous goods on railway transport by putting item 3 in the following wording: “The structure of licensed activities shall include loading and unloading of dangerous goods effected on railway transport.” Therefore, item 3 shall exclude the term “infrastructure”, which limits the area of regulation only to public railways.
